These Terms of Use ("Terms") apply to your use of tachyonowl.io and any related pages or subdomains we operate (together, the "Site"). The Site is operated by Epsilamic Solutions Inc. ("Epsilamic", "we", "us"), which operates under the trade name TachyonOwl. Please read these Terms carefully - by using the Site, you agree to them.
01Who we are & scope
TachyonOwl is a trade name of Epsilamic Solutions Inc., a company incorporated in Ontario, Canada. These Terms cover this informational website only. They do not govern the TachyonOwl software product itself, which is in private beta and provided under a separate written agreement to the businesses we work with directly.
02Accepting these terms
By accessing or using the Site, you confirm that you are able to form a binding agreement with us and that you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site. The Site is intended for businesses and adults; it is not directed at children.
03Pre-launch & forward-looking information
TachyonOwl is in active development. The Site describes capabilities at different stages - some live, some in progress, and some planned - and we label them honestly wherever we can. Any description of a planned or in-progress feature is forward-looking: it reflects our current intentions, not a promise, and it may change, be delayed, or be dropped. Nothing on the Site is an offer to sell, a guarantee of availability, or a commitment that any feature will ship on any particular timeline.
04Acceptable use
You agree to use the Site lawfully. You will not:
- use the Site for any unlawful, harmful, or fraudulent purpose;
- copy, scrape, harvest, or systematically extract its content or data, except as permitted by law;
- attempt to gain unauthorized access to, disrupt, or overload the Site or its infrastructure;
- introduce malware or interfere with anyone else's use of the Site; or
- misrepresent your identity or impersonate any person or organization.
We may restrict or block access to the Site if we reasonably believe you have broken these Terms.
05Intellectual property
The Site and its content - including text, design, graphics, the owl mark, the TachyonOwl name and logo, and other trademarks - are owned by or licensed to Epsilamic and protected by applicable law. We grant you a limited, personal, non-exclusive, revocable licence to view the Site for your own informational use. You may not reproduce, republish, or use our branding or content for commercial purposes without our prior written permission.
06Inquiries & booking a call
When you contact us or request a setup or discovery call, you are making a request - not entering into a contract. We may decline, reschedule, or follow up at our discretion. Any actual use of the TachyonOwl product is governed by a separate written agreement between you and Epsilamic. How we handle the contact details you provide is described in our Privacy Policy.
07Third-party links & services
The Site may link to, or rely on, third-party sites and services (for example, an external scheduling tool, or our font and hosting providers). We do not control those third parties and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms and privacy policies.
08Disclaimers
The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that the information on it is complete or current. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
09Limitation of liability
The Site is provided free of charge. To the fullest extent permitted by applicable law, Epsilamic and its directors, officers, and personnel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Site. Our total aggregate liability for all claims relating to the Site is limited to the smallest amount permitted by applicable law and, in any event, will not exceed one hundred Canadian dollars (CAD $100). Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (for example, in some places, liability for fraud, gross negligence, or personal injury).
10Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "effective" date shown at the top of this page. Your continued use of the Site after a change takes effect means you accept the updated Terms.
11Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute relating to the Site or these Terms.
